Advanced Employment Law and Litigation--2002

In an economy beset by layoffs and bankruptcies, the courts are experiencing a rise in retaliation and wage-hour litigation. In the wake of 9/11, employee privacy considerations are affected by the USA Patriot Act. These course materials examine current employment law trends and developments and key litigation questions, including evidentiary problems and the viability of arbitrations of statutory claims. Updates on race, sex, disability, ERISA, and retaliation are presented, as well as a discussion of the emerging U.S. Supreme Court Federalism rulings. The latest legislation on executive compensation and corporate ethics to restore public confidence in American capitalism is reviewed and analyzed. Arbitration as an alternative to jury trial is under constant attack from plaintiffs and reconsideration by employers, the effects of which are considered.
