Species Protection and the Law: Endangered Species Act, Biodiversity Protection, and Invasive Specie--2006

The Endangered Species Act (ESA) recently marked its thirtieth anniversary. Far from receding in its impact, the Act has instead grown in importance. ESA issues are now common and significant considerations in land development activities in many parts of the nation, particularly in the fast-growing Sun Belt states. The Act’s provisions also heavily affect other key economic activities such as timber harvesting, agriculture, aquaculture, electric power generation, and coastal development. Major lawsuits have been filed challenging the application and even the constitutionality of the ESA. To call the ESA the veritable "800-pound gorilla" of environmental legislation is to understate the Act’s importance to the species, agencies, landowners, developers, and citizens that fall within the ambit of the broadly worded legislation. In addition to the federal ESA, state-level legislation and protection programs are increasing in number and importance. Efforts in several states, from Delaware and Indiana to California and New York, seek to enhance and protect key aspects of biodiversity. An increasingly important aspect of state-level biodiversity protection is the control of nonindigenous invasive species. Species losses and threats have implications beyond the nation’s borders, involving several international and regional treaties to which the U.S. is a party and affecting important trade agreements.
