In a world where every terminated employee is a potential plaintiff, it is more important than ever for employers to have a solid grasp on how to draft valid and enforceable releases and waivers. Release agreements and waivers against claims are an essential part of any separation agreement and need to be carefully drafted and presented to employees to be enforceable. However, myriad state and federal statutes have produced a host of limitations on an employer’s ability to obtain enforceable waivers of claims and releases.
