Specially Designed Conference for Experienced Practitioners

 Will Cover Critical Issues in Commercial Finance

 

PHILADELPHIA, March 8, 2018.  American Law Institute Continuing Legal Education (ALI CLE) has announced that Advanced Commercial Finance 2018: Critical Issues Below the Surface will be held on May 11, 2018, in New York City. Through sophisticated guidance, this fast-paced program will offer high-level insights on the most significant and often overlooked challenges around secured lending transactions and applicable strategies for tackling them.  

 

The Advanced Commercial Finance 2018 conference is specifically designed for experienced practitioners. The national faculty will include law professors with significant scholarship, members of the Editorial Board for the Uniform Commercial Code, and practitioners with decades of experience in guiding clients through major commercial transactions. This course's smaller classroom setting provides generous opportunity for direct interaction with the distinguished faculty and fellow attendees. 

 

Topics to be addressed at the conference include: 

·       Who is the debtor? Trusts, business trusts, LLPs, and series LLCs 

·       Consignments and reclamation rights: When does the cosigner or seller win? 

·       Receivable financing: Is there a present right to a future receivable? 

·       Security interests in deposit accounts: When does a lien creditor trump a deposit account

control agreement? 

·       Proceeds: How long does attachment, perfection, and priority last? 

·       Article 9 v. equitable principles: Who wins?

·       Does Article 9 capture Going Concern Value?
